Welcome to https://www.sciencefairs.ca/ (the “Site”), owned, operated and provided by Science Fair Foundation of British Columbia, a society incorporated in the province of British Columbia, Canada (the “Society”, “we”, “us” or “our”).
BEFORE YOU CAN USE THE SITE, YOU MUST READ, UNDERSTAND AND AGREE TO BE BOUND BY THE FOLLOWING TERMS OF USE, all policies and terms incorporated by reference, and any subsequent changes to the foregoing. Your access to, and use of this Site is expressly conditioned on your acceptance without modification of the following Terms of Use. By using this Site, you signify your acceptance of these Terms of Use. If you do not agree with any part of the following Terms of Use, you must not use this Site.
We reserve the right to change or modify any of the terms and conditions contained in the Terms of Use or any policy or guideline of the Site, at any time and in our sole discretion. Any changes or modifications will be effective upon posting of the revisions and notice of such changes to the Site. Your continued use of this Site following the posting of changes or modifications will constitute your acceptance of such changes or modifications. Therefore, you should frequently review the Terms of Use and applicable policies from time to time to understand the terms and conditions that apply to your use of the Site.
These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with us for other services. All questions or comments about the Site or its contents should be directed to info[@]sciencefairs.ca.
1. Incorporated Policies or Terms
We believe strongly in protecting user privacy and providing you information regarding the processing of personal information collected from the Site. Therefore, we have adopted a Privacy Policy that you should refer to fully understand how we use and collect information.
2. Registration for Events
As part of the consideration for your acceptance of these Terms of Use, you may submit an application(s) (each, an “Application”) to participate in one or more science fair programs and other events organized and administered by the Society and access various educational resources available on the Site. As part of the Application, you may need to provide personal information, including your name, address, phone number, email address, home address, name of school, and answers to certain questions.
In consideration of your use of the Site, you agree:
- (a) to provide true, accurate, current and complete information about yourself;
- (b) that you represent and warrant that you have the capacity and authority to execute agreements;
- (c) that you are responsible for all costs and charges incurred in order to use the Site; and
- (d) that you are fully responsible for all activities that occur under your Application, and accept all liability for any acts or omissions arising out of your use of the Site.
If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may refuse any and all current and future use of the Site by you. Application information and certain other information about you is subject to our Privacy Policy.
3. Intellectual Property
All content included on this Site is the property of the Society and/or our third-party providers and distributors, and is protected under the intellectual property laws of Canada and other jurisdictions. None of the content found on this Site may be reproduced, republished, distributed, displayed, posted, transmitted, sold, transferred, or modified in any form or by any means, without the express written permission of the Society and/or its third-party providers and distributors.
The term “content” includes text, graphics, images, design, trademarks (including logos), audio, video, software, data compilations, and any other information capable of being stored in a computer, and the selection and arrangement of the foregoing that appears on or forms part of this Site.
SCIENCE FAIR FOUNDATION OF BRITISH COLUMBIA, the exclamation mark logo, YOUTH INNOVATION SHOWCASE and the YIS! logo and other trademarks and logos appearing on this Site are trademarks of the Society or our sponsors, and may not be copied, imitated or used, in whole or in part, without prior written permission.
4. Use of Site
We grant you a limited license to use this Site and to complete legitimate Application(s) and access the resources thereon. This license does not include:
- making derivative uses of the Site or its contents; or
- use of any data mining, robots, or similar data gathering and extraction methods.
You are not granted any right or license by implication or otherwise under any intellectual property rights of the Society or any third party, except as expressly provided.
You may download, display, and print materials for licensed purposes only. Without written permission, you may not:
- copy, publish, or post the materials on any website, network, or publication;
- modify the materials;
- remove or alter any copyright, trademark, or proprietary notices.
Unauthorized use may violate copyright, trademark, or other applicable laws. You may not frame or use framing techniques to enclose any proprietary information, nor use meta tags or “hidden text” with our trademarks or event names without express written consent.
5. Age and Responsibility
You represent that you are of sufficient legal age to use this Site and create binding legal obligations for any liability you may incur. You are financially responsible for all uses of this Site by you.
6. Termination
We may terminate or restrict your access to the Site, for any reason, including lack of use or violation of these Terms of Use or applicable law. We may delete all related information and files, and bar further access. We are not liable for such termination or restriction.
7. Disclaimer of Warranties and Representations
The Site and materials are provided “as is” and “as available”. We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, title, non-infringement, or any warranties arising by law, usage, or trade.
8. Limitation of Liability
YOU AGREE THAT THE SOCIETY, ITS DIRECTORS, OFFICERS, EMPLOYEES OR REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SITE. THIS INCLUDES ALL TYPES OF DAMAGES SUCH AS DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
OUR MAXIMUM LIABILITY SHALL NOT EXCEED CDN $100. This limitation may not apply in jurisdictions that do not allow such exclusions.
9. Indemnification
You agree to indemnify and hold harmless the Society and its officers, directors, employees, and agents from any claims or damages arising from your use of the Site or violation of these Terms. We reserve the right to assume the exclusive defense of any matter subject to indemnification.
10. Links
This Site may contain links to third-party websites. We are not responsible for the content of such sites and do not endorse or guarantee the information found there. Use third-party sites at your own risk.
11. Relationship
These Terms do not create a partnership, joint venture, agency, fiduciary, or employment relationship between you and the Society.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada. You consent to the exclusive jurisdiction of its courts in all disputes related to the Site and these Terms.
13. Assignment
You may not assign or delegate your rights or obligations under these Terms without our written consent.
14. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Headings
Headings are for reference only and do not affect the interpretation of these Terms.
16. Entire Agreement
These Terms, along with those incorporated herein, constitute the entire agreement between you and the Society regarding use of the Site and supersede all prior agreements. They may only be amended in writing or by posting changes on the Site.
